Biden Alters Title 9 to Include Transgender Students

The Biden administration issued a completed rule on Friday that broadens the scope of Title IX protection to encompass sexual orientation and gender identity.

Title IX, a federal law, forbids sex-based discrimination in public schools and universities that receive federal financing.

In 2022, the administration introduced a modified version of Title IX that would expand the scope of prohibitions to include discrimination based on “gender identity.”

The administration’s new rule, which has undergone months of review and public discussion, will be implemented on August 1, as stated in a news release from the U.S. Department of Education (DOE).

The rule does not specifically mention transgender athletes, despite past attempts by the administration to incorporate a provision that would prevent schools from disallowing biological males from participating in women’s and girls’ sports.

The administration is presently developing a distinct regulation that would forbid schools from implementing a uniform policy that purportedly discriminates against transgender athletes.

Legislation has been passed in approximately 25 states that imposes restrictions on transgender athletes participating in female sports categories.
