Supreme Court Justice Samuel Alito was commended by former President Trump on Wednesday for his refusal to recuse himself from forthcoming cases related to the 2020 election and Jan. 6, 2021, following the report that flags associated with the “Stop The Steal” initiative were flown outside his homes.
“Congratulations to United States Supreme Court Justice Samuel Alito for showing the INTELLIGENCE, COURAGE, and ‘GUTS’ to refuse stepping aside from making a decision on anything January 6th related,” Trump wrote on his Truth Social platform.
“All U.S. Judges, Justices, and Leaders should have such GRIT – Our Country would be far more advanced than its current status as A BADLY FAILING NATION, headed by the Worst President in American History, Crooked Joe Biden!” he added.
On Wednesday, Alito, who was nominated by former President George W. Bush, wrote a pair of letters to members of Congress denying any involvement in the flags that were flown over his homes.
He claimed that his wife, Martha-Ann, flew an upside-down American flag as part of a dispute with neighbors in Alexandria, Virginia.
The upside-down flag has traditionally been recognized as a distress signal.
Justices are prohibited from making political statements by the Supreme Court’s ethical code in order to maintain their impartiality regarding matters that are brought before the court.
The Supreme Court is scheduled to render a decision on a pair of critical cases in the upcoming weeks that are pertinent to the Jan. 6 attack. These cases include the determination of whether Trump is immune from prosecution.
Trump’s legal team is currently attempting to argue that a president has absolute immunity for official acts while in office, and that this immunity continues to apply after they leave office.
He and his counsel have contended that the protections encompass his endeavors to avert the transfer of power following his defeat in the 2020 election, which are the focal point of criminal charges against him.
