Earlier this week, a Michigan resident was taken aback by a cease-and-desist letter from Democratic Attorney General Dana Nessel that seemed to be a reprisal for the citizen exercising their constitutional right to free speech.
The letter threatened legal action against the woman for publishing social media posts that informed voters of a change in voting locations in Ross Township and claimed that the township had not adhered to the law regarding resident notification.
Kerry Lynn Elieff, who resides in Ross Township, near Kalamazoo, claimed that the cease and desist order did not specify the specific post that violated the law, but it required her to remove all “misleading or false election information.”
The letter was delivered to Elieff on Tuesday, the same day as the primary elections in the state.
The Midwesterner reported that Elieff maintains that her municipality failed to comply with the law, which mandates that voters be informed of a change in polling locations within 60 days.
She stated that she published numerous posts and videos on social media to inform her fellow electors in her township of the change.
“This CEASE and DESIST letter is to inform you that you are in violation of Michigan election law. It has come to the attention of our office that you have spread misleading or false election information regarding polling locations in Ross Township through on-line sites. Specifically, MCL 168.932(a) prohibits and criminalizes this conduct.” the letter reads.

“The polling locations in Ross Township were legally approved and selected by the township board and clerk. Any false or misleading information you posted should be removed across all platforms. Therefore, you are hereby ordered to CEASE and DESIST the use of online platforms to continue spreading false or misleading information regarding the Ross Township polling locations. Failure to comply with this notice may result in criminal prosecution.” it continued.
